1.    RELEASE.
Because we are not involved in the actual transaction between customer and Businesses, in the event that you have a dispute, for any reason, You release “TLC” (thereof My Home TLC Inc. Corporation and any officers, directors, agents, and employees) from claims, demands, and damages (actual or consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.


2.    TLC’S PROPRIETARY RIGHTS.
You acknowledge and agree that the Sites, Service and any necessary software used in connection with the Sites or Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that contents on the Sites or presented to you through the Service is protected by copyrights, trademarks, patents and other proprietary rights and laws.  From time to time, “TLC” may (and has the right to) send you information and offers about upgrades, documentation, special announcements and other services offered by TLC. Notwithstanding the foregoing, under no circumstances will TLC or any of its Partners have any obligation to provide you with upgrades, enhancements, modifications, or support for the Services or Sites.

The “Site” database grows and changes daily, and therefore “TLC” does not claim to have an all-inclusive list of contractors in your area.  In selecting a contractor, you take responsibility for verifying licensing information, checking references, and researching contractor history including insurance, credit and/or legal standing before hiring a contractor.  In negotiating terms specific to the work to be performed, we suggest you consult experts including but not limited to a contract/permit lawyer and an insurance specialist regarding coverage needs during the course of a project. The “Site”- (Referral Service) does not endorse or recommend the services of any contractor, and we make no guarantees regarding the skills or quality levels of the service professionals listed in your area. “TLC” does not guarantee the qualifications, legal standing, licensing, or background of any service provider who may be passed on to the homeowner. The contractors listed on the “Site” neither are not employees or partners of “TLC” nor is “TLC” an agent of the contractors. “TLC” is not responsible for the completion of your service need, and although we want users to have a positive experience by use of this “site”. “TLC” is not responsible for your project to be completed with satisfaction or for any following guaranties after. The contracts you enter into with contractors are independent of “TLC” and are governed by the contract terms and by applicable federal, state, provincial and local laws. If disputes arrive concerning your chosen contractor, you must address such disputes with the contractor directly; The “TLC” IS NOT responsible for handling any such dispute.   YOU AGREE TO RELEASE “TLC”.  (and our employees and agent any other person, firm, or entity including our business partners such as a product manufacturer or supplier who may employ the “TLC” matching utility) from any damages or claims (including consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and your dealings with service professionals.
 
7.     Changes to the Service or Terms.
“TLC” may change or amend these "Terms and Conditions of Use" at any time. We may add, remove, or change features of our service and/or web site at any time. We may modify these Terms and Conditions from time to time and such modification shall be effective upon posting on the Site. As such, “TLC” makes no guarantee that the Third Party contractor services will meet your job requirements and/or bring a project to completion with satisfaction.  Your use of information and contractor lists available on the “Site” are at your own risk and discretion, and it is solely your responsibility to investigate information and contractors provided throughout The “Site”. YOU WAIVE THE RIGHT TO FILE SUIT AGAINST “TLC” (My Home TLC, Inc.)  OR ANY OF OUR EMPLOYEES, AGENTS, DIRECTORS, OWNERS, PARTNERS, AND AFFILIATES. If you have any dissatisfaction with the information supplied on The “Site” it is your right to discontinue the use of our “Site” and/or you may cancel your FREE account at any time.

9.    Site and Services
My Home TLC Inc. (TLC) websites are lead generation services that match requests form potential customers (user) with independent contractors (contractors) or entities listed in our section SERVICES that may be able to meet customers’ needs. “TLC” is NOT involved in the actual transaction between user and contractor.”TLC” will transfer all your requests and communications to the contractors but consequently cannot ensure that a service or transaction will occur. Further, if a transaction does occur, “TLC” has no control over the quality, safety or legality you more information in our general disclaimer. If “TLC” is unable to match users request with “contractor “within our network TLC will NOT match user with any other contractors outside network. “TLC” DOES NOT CHARGE user for using the account unless noted otherwise. All charges associated with this service are incurred by the contractor that responds to user’s request. TLC is not responsible for user’s access to or ability to use email, or the filtering policies of any internet service or email providers and is consequentially not liable for any losses or inconveniences which may arise from undelivered email notifications. We do not guarantee that we will be able to match your service needs with a service professionals listed on our websites. We cannot also promise that there are service professionals in your area that either are capable or willing to complete your service needs. Although we take certain steps to examine the credentials of our listed independent “contractors”, we make no guarantees or representations regarding the application or installation skills of such service professional or the quality of the job that he or she may perform for you if you choose and select to retain their services. It is entirely up to you to enter into a direct contract or otherwise reach agreement with a service professional, and we do not guarantee or warrant their performance on the job or the outcome or quality of the services performed. Your rights under the contracts you make with service professionals and “contractors” typically are governed by your state and local laws. Should you have a dispute with any service professional, you must address such dispute to the service professional directly, and you hereby agree to release “TLC”.  (and our employees and agents any other person, firm, or entity including our business partners such as a product manufacturer or supplier who may employ the “TLC” matching utility) from any damages or claims (including consequential and incidental damages) of every kind or nature, suspected and unsuspected, known and unknown, and disclosed or undisclosed, arising out of or in any way connected with such disputes and your dealings with service professionals. 

10.    CONDUCT Limitation and Liability Release.
 Please use common sense and practice safe trading when using the “Site”. You agree to provide true, accurate, current and complete information to “TLC” and Businesses when using the “Site”. You may not allow anyone else to use your “Site” account and you may not use anyone else's “site” account while using “TLC” “Sites”. You agree to notify "TLC" immediately of any unauthorized use of your “site” account or any other breach of security. "TLC" will not be liable for any loss of records or damage arising from your failure to comply. “TLC” will not be liable for damages of any kind relating to your use of information and services on the “Site”. You are releasing “TLC” of total liability for any such suit relating in any way to our “Site”

11.     Indemnity.
You agree to indemnify and hold us, and our subsidiaries, affiliates, directors, officers, agents, vendors or other partners and employees harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising out of any material or information posted, provided, transmitted or otherwise made available by you on the Site or through the Site's services, or by your violation of these Terms and Conditions, or by your violation of the rights of another.

 You agree that all of the content, information (including contractor information and Ratings and Reviews), and logos on the “Site” are owned by “TLC” or business partners, and affiliates unless otherwise noted. Company images and logos submitted by “contractors” and businesses in our network to update their company profile remain in the ownership of the “Contractor” or business partners, and affiliates. You may copy information from The “Site” for personal use, but you are not permitted to reproduce, distribute, transmit, publish, or otherwise use information on our web site for commercial purposes without written permission from “TLC".

13.     Privacy Policy.
 “TLC” respects your privacy and will NEVER sell your personal information to Third Party sources, except where a specific project request has been submitted and the information is passed to the specific “contractor” who matches your requests.  All “User” and “Contractor” information is kept private, except that “User’s” information is passed to Third Party sources ONLY when a "Project Request" is submitted by the “User”. In submitting a "Work Order/quote" form, you promise to be truthful and accurate to the best of your knowledge. “TLC” has the right to terminate relationship with you immediately if the information you provide is inaccurate in any way.  By submitting a "Work Order/quote", you consent to being contacted by any means by “TLC”  “Contractor”, independent “contractors" and/or our partners in regards to process your request. 14.     Links to Third Party Sites
The “Site” has links to other web sites not owned or operated by “TLC”.  These links are for the user's convenience and are not intended as endorsement for “TLC” of any of these sites. “TLC” is not responsible for the contents and information you may obtain through Third Party sites, and they are to be used at your sole discretion. “TLC” also relies on electronic data provided by third parties and on statements made by service providers and their references to determine which service providers to include in our database. Due to the inherent time delay in the data gathering process, pending actions or other issues affecting a service provider's record may have occurred which were not captured by the third party data sources used. “TLC” does not guarantee that any service provider has licensing or insurance coverage at the time you enter into an agreement with the service provider and makes no representation as to the adequacy of any licensing or insurance coverage (including amount, breadth, or type). The existence of an insurance or licensing certificate does not guarantee that the insurance is in effect, as the service provider may cancel the insurance without any notice to My Home TLC Inc. Unless otherwise specifically stated, My Home TLC Inc. does not endorse any product or service described in, offered on, or linked to My Home TLC Inc.  Websites and any promotional materials including text, audio, video or other materials.

15.     Termination of Account. You may terminate your account and your use of The “Site” at any time and for any reason or no reason by contacting “TLC”.  Likewise, “TLC” reserves the right to terminate your account for any reason. If your account is terminated you are still required to pay any outstanding balances to independent contractors hired throughout our free-based “Site”.

16.    Contractor is prohibited from soliciting the user without "TLC's" prior knowledge. Contractor has signed non-competition agreement and will be held accountable and responsible for any damages made to TLC via signed agreements and contracts.

17.     By Using My Home TLC Inc. websites and accepting our terms and conditions you understand that you are using services listed on our websites on your own risk and you will withhold My Home TLC Inc. and our employees, agents, business owner, partners and any other person, firm, or entity including our business partners of any responsibility for lost data on our websites or any damages or legal claims. All the website services and functions on My Home TLC Inc. sites are offered only for your personal use as informational, educational and communication between you and listed independent contractors through our featured functions and content.


18.    Without limiting any other provisions of this Agreement, you may not use this Site for any purpose that is unlawful or prohibited by this Agreement and/or any applicable additional terms. Your access to this Site may be terminated immediately in our sole discretion, with or without notice, if you fail to comply with any provision of this agreement and/or additional terms, or for any other reason, or no reason. You expressly agree not to:
•    Use this Site or its contents for any commercial purpose;
•    Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
